1. Who we are
Prodesk (ABN 38 696 024 432, ACN 696 024 432) ("we", "us", or "our") operates a platform that connects brands, agencies, and independent contractors to plan, deliver, and pay for creative and professional work. We are committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Our registered business address is 227/10 Albert Avenue, Broadbeach QLD 4218, Australia.
This policy applies to all users of our platform, including brand owners, agency owners, staff members, and individual contractors. By using Prodesk, you consent to the collection and use of your information as described here.
2. Information we collect
We collect personal information that is reasonably necessary to provide and improve our services. The types of information we collect include:
- Account information — your name, email address, password, and the role you select (brand, agency, or contractor).
- Profile and business information — company or brand name, logo, profile details, descriptions, and the disciplines or services you offer.
- Content you provide — proposals, projects, tasks, messages, files, deliverables, and other materials you upload or create on the platform.
- Payment and financial information — billing details, payout details (such as bank or Wise account information), invoices, and transaction history. Card details are handled by our payment processor and are not stored by us.
- Communications — messages you exchange with other users through our chat features, and any correspondence you send to our support team.
- Usage and technical data — IP address, device and browser type, log data, pages viewed, and interactions with the platform, collected automatically through cookies and similar technologies.
3. How we collect your information
We collect information directly from you when you create an account, complete your profile, create or accept proposals, exchange messages, make or receive payments, or contact us for support.
We also collect information automatically through your use of the platform, and we may receive information from third parties such as authentication providers (for example, when you sign in with Google) and our service providers.
4. How we use your information
We use your personal information to:
- Create and manage your account and verify your identity.
- Provide, operate, and maintain the platform and its features.
- Facilitate connections, proposals, projects, and communications between brands, agencies, and contractors.
- Process payments, payouts, commissions, invoices, and subscriptions.
- Send you transactional and service-related communications, including email verification and notifications.
- Respond to your enquiries and provide customer support.
- Monitor, analyse, and improve the performance, security, and usability of our services.
- Detect, prevent, and respond to fraud, abuse, security incidents, and breaches of our Terms.
- Comply with our legal obligations.
5. Disclosure of your information
We do not sell your personal information. We may disclose your information in the following circumstances:
- To other users — when you connect with a brand, agency, or contractor, relevant profile, proposal, project, and communication information is shared with the parties you work with.
- To service providers — we use trusted third parties to host data, send email, process payments and payouts, and provide analytics. These include cloud and infrastructure providers, our email delivery provider, and payment providers such as Stripe and Wise.
- For legal reasons — where required by law, regulation, legal process, or enforceable governmental request, or to protect the rights, property, or safety of Prodesk, our users, or others.
- In a business transfer — in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality protections.
6. Overseas disclosure
Some of our service providers may store or process information outside Australia, including in jurisdictions where our cloud, email, and payment providers operate. Where we disclose personal information overseas, we take reasonable steps to ensure it is handled in a manner consistent with the Australian Privacy Principles.
7. Data security
We take reasonable technical and organisational measures to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. These measures include encryption in transit, access controls, and secure infrastructure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Data retention
We retain your personal information for as long as your account is active or as needed to provide our services, and thereafter only as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer required, we will take reasonable steps to delete or de-identify it.
9. Cookies and tracking technologies
We use cookies, local storage, and similar technologies to keep you signed in, remember your preferences (such as your theme), operate the platform, and understand how it is used. You can control cookies through your browser settings, but disabling them may affect the functionality of the platform.
10. Your rights
Under the Australian Privacy Principles, you have the right to request access to the personal information we hold about you and to request that we correct it if it is inaccurate, out of date, incomplete, irrelevant, or misleading. You can access and update much of your information directly through your account profile.
To make a request, or if you wish to withdraw consent or have us delete your information where we are not required to retain it, please contact us using the details below.
11. Children
Our platform is intended for use by businesses and professionals and is not directed at children. We do not knowingly collect personal information from anyone under the age of 16. If you believe a child has provided us with personal information, please contact us so we can delete it.
12. Third-party links and services
The platform may contain links to, or integrate with, third-party websites and services. This policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third party you interact with.
13. Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices or legal obligations. We will post the updated policy on this page and revise the effective date above. Your continued use of the platform after any change indicates your acceptance of the updated policy.
